Often times, couples hesitate to file for divorce because they imagine the process to be highly contentious and aggressive, much like you see on television.

However, in reality, it is not always like that and there are options people have for them to divorce in a more amicable, less adversarial way.

Mediation

Mediation is a form of alternative dispute resolution. It is highly effective and courts around the country embrace mediation because it helps minimize the number of cases they have to process.

How does mediation work?

You meet with a mediator (and your attorney, if you wish) and the other party (as well as their attorney, if they wish, though it is optional to have lawyers present) and have a structured conversation about what both parties want, as well as how they can get closer to getting as much as they want or need as possible.

In other words, the mediator wants both parties to get as much as possible in a mediation. However, there will always be a give-and-take and it is critical for parties to understand that when they are doing into mediation.

Benefits of mediation

The benefits of mediation are many, including:

  • Being less costly than litigation.
  • Being a confidential and private process.
  • Being a faster way of divorcing.
  • If both parties agree, the agreement is legally binding.

If you and the other party are able to come to an agreement that benefits both of you, the court will have to accept it.

While mediation is not for everyone, it is a highly effective, efficient and popular way of solving conflict. Many couples turn to mediation because of its high success rate and the many benefits it provides.
