Proposed bill could affect child custody laws in Texas

Throughout the country, divorce is a reality that many families must face. One of the most difficult aspects of divorce is dealing with child custody. While every situation is different, it is not uncommon for one parent to be granted more time with the children than the other parent. However, a new Texas bill is looking to change that by insuring both parents receive equal time with their children.

This new bill is known as Texas House Bill 453 and is similar to other reforms previously implemented in other states. It was filed by Texas state Representative James White in Nov. 2016. While the ultimate purpose of the bill is to address child custody rulings, its supporters have stated that it could greatly decrease the cost of divorce as well.

Though the bill has gained many supporters, it also has its share of opponents. Rep. White attempted to pass a similar bill two years ago without success. The detractors believe that the Texas House Bill 453 could not adequately provide the best custody situation for each child and every family. The factors involved in divorce cases can differ so greatly between cases, they feel that each judge must decide on a case-by-case basis to suit the needs of each individual family.

While supporters of Texas House Bill 453 hold out hope for change, it is reported that no significant child custody law reforms have passed in Texas since 1970. At this time, the bill is still waiting to be referred to a committee. Regardless of the success of this legislative proposal, any Texas parent who is involved in a child custody case may want to consult a family law attorney to protect individual interests while pursuing a solution that is in the best interests of any child involved.
